Record of Ex-CJN Onnoghen’s CCT case file declared missing

The Attorney General of the Federation and Minister of Justice (AGF) has announced that they are unable to locate the case file for the trial of former Chief Justice of Nigeria (CJN) Samuel Walter Nkanu Onnoghen, even though it has been five years since the trial ended.

In 2019, Onnoghen was taken to court by the federal government on accusations of providing false information about his assets at the Code of Conduct Tribunal.

He was found guilty, removed from his position, and instructed to surrender the undisclosed assets to the government.

During the Court of Appeal session in Abuja on Tuesday, Tijani Gazali, representing the federal government, revealed that the Attorney General’s office does not possess any documents linked to the trial and sentencing of the former CJN.

Gazali clarified that the case was handled by a private attorney, Aliyu Umar, who has since died. He requested the court to postpone the proceedings to allow time for the government to obtain essential records from the late lawyer’s office.

The lawyer representing the former CJN, Chris Uche, mentioned that certain papers were given to the AGF office and were confirmed received. He asked the court for permission to file a request for a speedy trial, which was approved.

The Court of Appeal has scheduled September 19 for the hearing of the appeal. Onnoghen is asking the court to overturn the decision of the CCT that led to his removal from office and mandated the confiscation of his five bank accounts.
